Seller Terms of Service for Mayhem Marketplace

Welcome to Mayhem Marketplace! By listing and selling on our platform, you agree to these terms, which are designed to ensure a safe, creative, and lawful environment for all users. Please read carefully.

1. Eligibility and Scope

Seller Eligibility: You must be at least 18 years old to sell on Mayhem Marketplace. By using our platform, you affirm that you meet this age requirement and comply with any identity verification requirements if requested.
Agreement to Terms: By posting content, you agree to follow these Terms of Service. If you violate any terms, Mayhem may suspend or terminate your account.
Addenda: These terms may incorporate additional addenda, such as the Mayhem RED Seller Terms Addendum, which apply to specific content types or categories. By using Mayhem Marketplace, you agree to comply with all applicable addenda.

2. Prohibited Content and Listings

Illegal Content: Only list and sell items or post content that complies with all U.S. laws. If it’s illegal in the United States, it’s not allowed on Mayhem Marketplace.
Adult Content: Explicit adult content is prohibited on Mayhem Marketplace but permitted on Mayhem RED subject to the Mayhem RED Seller Terms Addendum.
Alcohol, Tobacco, and Firearms: No items or content related to alcohol, tobacco products, firearms, or related accessories are permitted.
CBD or THC Products: No products containing CBD or THC are allowed on Mayhem Marketplace.
Controlled Substances and Hazardous Materials: Items classified as controlled substances, hazardous materials, or counterfeit goods are strictly prohibited.
Hate Speech, Harassment, and Discrimination: Mayhem Marketplace has zero tolerance for hate speech, harassment, discriminatory content, or any material that promotes harm or abuse.
Human Rights and Dignity: We are outspoken supporters of human rights and dignity for all people. We will restrict or remove any content that does not respect the dignity of marginalized groups.
Intellectual Property and Copyright: You must own or have the rights to sell any content or items you post. Do not post or sell any copyrighted or trademarked material that you don’t own or have permission to use.
Drop-Shipped Products: You can only list items that you have in your possession; that you have created, crafted, or previously acquired. Drop-shipped products are not allowed. Print-on-demand products are allowed if the design is original and created by you.
Fraudulent or Misleading Content: Do not post false or misleading information, including fake reviews, deceptive pricing, or inaccurate product descriptions.
SEO Farming, Spam, or Malware: Do not engage in SEO farming, spamming, or posting malicious content or links.
Proselytizing, Missionary: No proselytizing or missionary work is allowed on Mayhem Marketplace. Religious iconography (crosses, crescents, Buddhas, etc) is allowed, however content that promotes a specific religion is not, even as "educational material".
Products Promoting or Encouraging Prohibited Content: Items that are not specifically prohibited, but that promote prohibited content, are also prohibited and subject to de-listing from the marketplace, storefront, or user account suspension.

3. Marketplace and User Conduct

Misleading Listings: Do not post misleading descriptions, fake reviews, or engage in price manipulation or deception.
Interactions with Buyers: All communication with buyers should be honest, respectful, and in line with these guidelines. Fraud, harassment, or misuse of buyer information is prohibited.
Data Protection: You may only collect buyer information as necessary for order fulfillment. Misusing or sharing buyer data is strictly forbidden.

4. Monitoring, Compliance, and Risk Management

Content and Transaction Monitoring: Mayhem Marketplace monitors listings, keywords, and user activity for compliance. Suspicious listings or transaction patterns may be flagged and reviewed.
Behavioral Monitoring: User accounts may be monitored for unusual or suspicious behavior patterns. Sudden changes in listing patterns, repeated policy violations, or high-risk activities may trigger additional review.
User Verification and Risk Scoring: Sellers may be subject to identity verification and risk scoring to reduce the likelihood of fraud or high-risk transactions.

5. Content Moderation and Enforcement

Right to Remove Listings: Mayhem Marketplace reserves the right to remove any listings or content that violate these terms, potentially without notice.
Suspension and Termination: We may suspend or terminate your account if you breach these terms. You may appeal this decision by contacting us within 30 days of account suspension or termination.
Reporting Violations: We encourage users to report any content or conduct that violates these terms to help us maintain a safe and positive community.

6. Use of Artificial Intelligence

Prohibited AI Art Sales: Sellers may not sell AI-generated art, images, or other AI-created products on Mayhem Marketplace. This includes but is not limited to AI-generated paintings, drawings, digital art, photographs, music, writing, or any other creative works where AI was the primary creator.
Acceptable AI Use: AI image generation is permitted for creating background images for your store or product cover images for services you provide (where you are selling the service, not the image itself). For example, you may use AI to create a background for your store page or a cover image for a consulting service you offer.
AI Tool Assistance: AI tools may be used to assist in the creation of physical products or services where the AI serves only as a tool and the seller provides substantial human creativity, skill, and labor. The seller must be the primary creator and contributor to the final product.
Disclosure Requirements: Any use of AI tools, even in acceptable contexts, must be clearly disclosed in product listings and descriptions.
Compliance with Terms: AI tools may not be used to create content that violates these terms, such as hate speech, harassment, illegal materials, fraudulent or misleading content, or prohibited items.
Content Rate Limits: AI tools may not be used to "content farm" product listings or create large quantities of similar products with minor variations.
Rights of Others: AI tools may not be used to create content that infringes on the intellectual property rights of others or creates unauthorized likenesses of real people.

7. Liability and Indemnity

Limitation of Liability: Mayhem Marketplace is not liable for any damages arising from your use of the platform, including lost profits, data, or any disputes between you and buyers. We provide our platform “as is” without any warranties.
Indemnification: You agree to indemnify and hold Mayhem Marketplace harmless from any claims, losses, or legal actions resulting from your content, listings, or conduct on the platform.

8. Dispute Resolution and Governing Law

Dispute Resolution: If a dispute arises between you and Mayhem, we encourage you to contact us directly. In the event of a legal dispute, you agree to resolve it through binding arbitration rather than court proceedings.
Jurisdiction and Governing Law: These terms are governed by the laws of Delaware. Any legal actions related to these terms will be brought in the courts of that state.

9. Changes to Terms of Service

Right to Modify Terms: Mayhem Marketplace reserves the right to update or change these terms at any time. Continued use of the platform constitutes acceptance of the updated terms.
