Mayhem RED Seller Addendum

An Addendum to the Mayhem Marketplace Seller Terms of Service

Effective Date: May 15, 2025

This Addendum only applies if you sell sexually‑explicit or age‑restricted content on Mayhem RED. It is incorporated by reference into the Marketplace Seller Terms (the “Master Terms”). If a clause in this Addendum conflicts with the Master Terms, this Addendum controls for Mayhem RED matters.

1 Definitions

Term Meaning
“Addendum” This Mayhem RED Seller Addendum.
“Adult Content” Any depiction of real, simulated, or animated sexually‑explicit conduct, nudity intended for sexual arousal, or fetish content that card‑brand rules classify as “high‑risk” or that triggers U.S. 18 U.S.C. § 2257 record‑keeping obligations.
“Performer” Every individual whose image, voice, or likeness appears in Adult Content.
“Uploader” / “Seller” The Marketplace account holder who lists Adult Content for sale or distribution on Mayhem RED.
“2257 Records” The age‑verification and identity records required by 18 U.S.C. § 2257 & 28 C.F.R. 75.

2 Eligibility & Mandatory Compliance

  1. 18+ Only. Uploaders and all Performers must be at least eighteen (18) years old (or the age of majority where they reside, if higher). Minors are strictly prohibited from appearing in any Adult Content.

  2. Identity Verification. You must complete Mayhem RED’s Model Release and Consent agreement and selfie‑ID check before listing Adult Content.

  3. Independent‑Contractor Status. Uploaders and Performers act as independent contractors. Nothing herein creates an employment relationship with Mayhem Makers LLC (“Company”).

3 2257 Record‑Keeping & Inspection

  1. Primary vs. Secondary Producer. Uploader acknowledges that they or their studio are the “primary producer” under 28 C.F.R. § 75. Company operates only as a secondary producer.

  2. Record Creation & Storage. Uploader must create, maintain, and retain 2257 Records for at least seven (7) years after the most recent date of production. Company stores a mirrored copy via the compliance upload tool.

  3. Inspection. You must produce 2257 Records to Company, law‑enforcement, card brands, or regulators within seventy‑two (72) hours of a written request.

4 Content Standards

4.1 Zero‑Tolerance Prohibited Content

The following categories are permanently banned and may not be uploaded, sold, streamed, or linked on Mayhem RED under any circumstances:

  • Minor depictions — any real, perceived, or simulated minor in sexual context.
  • Incest, bestiality, necrophilia.
  • Sexual violence or non‑consensual acts depicting real harm (rape, trafficking, force, or intoxicated inability to consent).
  • Blood, scat, vomit, or extreme‑injury fetish (“gore”).
  • Deepfakes or AI‑generated likenesses of real persons without that person’s signed consent.
  • Illegal or unlicensed firearms or controlled‑substance use.
  • Public sex filmed in places where the conduct was illegal.

Violation of this subsection may result in immediate account termination and referral to law‑enforcement authorities.

4.2 Restricted Content — Allowed With Enhanced Safeguards

The following content is permitted only if you satisfy the additional documentation, labeling, and safety measures below. Failure to meet these safeguards will be treated as a Zero‑Tolerance violation.

Documentation Upload: All additional consent videos, scene riders, location releases, and safety certificates must be uploaded alongside the primary 2257 Records for that scene. Company may refuse or remove any content that, in its sole judgment, poses excessive legal, reputational, or payment‑network risk, even if the above conditions are met.

5 Model Release & Co-Performer Rules

  1. Mandatory Form. Every Performer must sign the current “Model Release and Consent Agreement” (v1.0 or successor) on file. Digital copies must be uploaded via the Mayhem RED 2257 Compliance portal before the related content goes live.

  2. Co‑Performer Responsibility. Uploaders may not list content unless every co‑performer has: (a) signed the Model Release, (b) provided ID/selfie documents, and (c) passed Mayhem RED's review.

  3. PASS Testing. Where content depicts physical sexual contact among two or more performers, all participants must have a negative PASS‑compliant STI test taken within the preceding 14 days. Documentation must be retained alongside 2257 Records.

  4. Fair Compensation. Where content contains more than one performer, Uploader must ensure that all performers are fairly compensated for their work. Uploader must provide proof of payment to each performer, which may include a copy of the payment transaction or a signed agreement outlining the terms of compensation.

6 Age‑Verification, Geo‑Blocking & Customer Access

  1. Age‑Gating. Company will serve Adult Content only to customers whose age has been verified through industry‑standard methods (e.g., ID‑scan + biometric selfie, or accredited third‑party database checks).

  2. Restricted Territories. Company may geo‑block sales to jurisdictions where Adult Content is illegal or where card‑brand regulators so direct.

  3. Labeling Duty. Uploader must tag each listing accurately with the required 2257 “Records located at” statement, categories, content descriptors, and trigger warnings.

7 Payment Processing, Reserves & Chargebacks

  1. High‑Risk Reserve. Company or its acquiring bank may establish a rolling reserve or payout delay (up to 14 days) on RED sales to manage chargeback risk.

  2. Compliance Hold. Company may freeze payouts or remove content if it reasonably suspects a violation of this Addendum, card‑brand rules, or law.

  3. Chargeback Liability. Uploaders agree to reimburse Company for chargebacks, fines, or assessments attributable to their content or conduct.

8 Content Review, Takedown & Audit Rights

  1. Pre‑Publication Review. All Adult Content is subject to Company’s human + automated compliance check before it can be sold.

  2. Takedown Requests. Performer takedowns will follow Section 4 of the Model Release. Third‑party copyright takedowns follow 17 U.S.C. § 512 (DMCA).

  3. Audit. Company may audit compliance records on 5 business‑days’ notice; failure to cooperate may result in suspension or permanent ban.

9 Indemnity & Limitation of Liability (Supplemental)

In addition to the Master Terms, Uploader agrees to indemnify, defend, and hold harmless Company from any claim arising out of:

  • Misrepresentation of age, consent, or identity;
  • Failure to keep or produce 2257 Records;
  • Content that violates Section 4 (Prohibited content);
  • Health & safety claims related to PASS testing or performer injury.

Company’s aggregate liability under this Addendum shall not exceed the greater of USD $1,000 or the net revenue earned by Uploader on Mayhem RED in the preceding 12 months, except where prohibited by law.

10 Modification & Incorporation

  1. Incorporation. The Master Terms and this Addendum together form the complete agreement between you and Company for Mayhem RED.

  2. Conflicts. If a clause in the Master Terms and a clause in this Addendum conflict, this Addendum controls for Mayhem RED operations; the Master Terms control in all other respects.

  3. Updates. Company may modify this Addendum on at least 30 days’ written notice. Continued listing or sale of Adult Content after the effective date of a change constitutes acceptance.
